Kirby Explorer License Agreement

About this Agreement

Kirby Explorer is free to use — but it is not open source. This Agreement tells you what you may do with it, what you may not, and what happens when you activate a domain.

Installing or using Kirby Explorer means you have read this Agreement and agree to it. If you do not agree, please do not install or use it.

Summary

The short version, so you know what you are getting into:

You may use Kirby Explorer for free, in as many projects as you like, including commercial ones and projects you build for clients.
Each domain is activated once. Activation is free and does not expire.
Activating sends us the domain, so that we know where the plugin is in use. We store the domain, the key and the date — nothing about your content, your users or your files.
You may not sell it, republish it or pass it off as your own, and you may not remove or circumvent the activation.
It comes as it is, without a warranty.

Only the sections below are binding.

Definitions

"You" is the individual or company installing or using the plugin. If you install it for a client, you are the licensee, not the client.
"We"/"Us" is Christian Fickinger, who publishes as kirbydesk. Contact: hello@kirbydesk.com; postal address and further details at https://kirbydesk.com/imprint.
"Plugin" is Kirby Explorer. Its "Source Code" is every file distributed with it — PHP, JavaScript, CSS and everything else.
A "Website" is one Kirby project, defined by its domain and root directory. Each domain and subdomain is a separate Website.
A "Local Installation" is a Website that is not publicly reachable — a personal computer, a network with restricted access, or a site behind a password. Local Installations never need activation.

Your license

We grant you a non-exclusive, worldwide, perpetual license to install and use the Plugin on any number of Websites, free of charge. The license is granted for as long as you comply with this Agreement.

You may:

use the Plugin for private, commercial and client projects
install it for a client and hand the project over to them
keep using any version you have installed, for as long as you like
adapt its configuration and translations for your own installation.

What you may not do

You may not:

sell, rent, sublicense or otherwise distribute the Plugin, on its own or as part of a theme, kit, template or other product
publish the Source Code, in whole or in substantial part, anywhere else
remove, disable or circumvent the activation, or issue license keys yourself
remove copyright notices or claim the Plugin as your own work.

Modifying the Source Code for your own installation is permitted, but the result stays under this Agreement and must not be distributed. We do not support modified installations.

Activation

Each publicly reachable Website is activated once. Activation is free, takes one click in the panel, and the resulting key does not expire.

When you activate, the Plugin sends the domain of the Website to activate.kirbyexplorer.com. Our server verifies that the domain really runs the Plugin, and stores the domain, the key and the date. If you request a key through the form on the website instead, it also stores the email address you give us, so that we can send the key to you.

We keep this to know where the Plugin is used, and the email address to answer you. We do not send you unrelated email, and we do not pass the data on to anyone else. Write to hello@kirbydesk.com and we will remove your entry.

Nothing about your Website's content, its files, its users or their activity is ever transmitted. After activation the Plugin works entirely offline; it does not contact us again.

Local Installations are never asked to activate.

Updates

Updates are provided at our discretion and are covered by this Agreement. We may change the Plugin, its features or this Agreement for future versions. The version you have installed keeps the terms it came with.

No warranty

The Plugin is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. You use it at your own risk, and you are responsible for keeping backups of your projects.

Liability

To the extent permitted by law, we are not liable for any damages arising from the use of the Plugin, including loss of data, loss of profit or business interruption. This limitation does not apply to damages caused intentionally or by gross negligence, or to liability under the German Product Liability Act.

Termination

This license ends automatically if you breach this Agreement. Should that happen, you must stop using the Plugin and remove it from your Websites.

Governing law

This Agreement is governed by the laws of the Federal Republic of Germany. If any provision is found to be invalid, the remaining provisions stay in effect.
